This Privacy Policy should be read in conjunction with the Conditions of Use and where there is a conflict between this document and the Conditions of Use the later shall always prevail. The same definitions on page one of the Conditions of Use are to be used when reading and interpreting this policy.

The current Privacy Policy will remain posted on the UTOOL.com.au site as amended and may be amended from time to time without any notice to you. From the time of any amendment to the Privacy Policy, any amendments posted will apply to every new and existing Website User instantly. It is a strict condition of use that you will familiarise yourself and remain familiar with the Conditions of Use and Privacy Policy by reviewing them from time to time.

A.Explaining UTOOL's Privacy Policy and how it relates to your personal information:

UTOOL collects information about users of UTOOL.com.au from a variety of sources. These sources include business partners, advertisers, mailing lists, contractors and members of the public.

We will ask you when we need information that personally identifies you (personal information) or allows us to contact you. Generally, this information is requested when you register for UTOOL.com.au. When you register, you will give us your name, and you will nominate a username and password. Your username must be a valid email address.

We use your personal information for six primary purposes:

  • to make UTOOL.com.au easier for you to use by not having to enter information more than once
  • to personalize and customize your experiences on UTOOL, by having all your transaction details easily available in a personal workspace set up for you
  • to help us create content that's most relevant to you
  • to alert you to available jobs, product upgrades, special offers, updated information and other new services from UTOOL
  • to help UTOOL manage and enhance its services
  • to communicate with you

When you order services or purchase credit from us, we ask you for your credit card number and your billing address. We use this information to bill you for the product(s) that you order from us, but we don't use this information again without your permission.

UTOOL obtains most personal information through the UTOOL.com.au registration process outlined in the Conditions of Use and above. You may, however, provide information through a variety of different means (for example if you contact UTOOL.com.au via email, or you provide feedback using one of the forms found on UTOOL.com.au).

TOOL endeavours to collect personal information about an individual only from that individual. In some circumstances UTOOL may obtain personal information from a third party. If you provide personal information about another person to UTOOL.com.au, UTOOL requires that you inform that person you have done so and provide them with a copy of this policy.

B.Consent

If you choose not to make available your personal information, you will not be able to use the UTOOL.com.au services.

After registering with UTOOL, you will be able to select the kinds of information you want to receive from UTOOL, and by which means you wish to hear from us, including via email, SMS, telephone, post and/or fax. If you don’t want us to communicate with you about offers regarding UTOOL's products, programs, events or services, you may opt out from these communications by emailing privacy@utool.com.au.

UTOOL occasionally allows other companies to offer our registered customers information about their products and services. If you don’t wish to receive these offers, you may select the option stating that you don't wish to receive marketing or promotional materials from third parties.

C.User Information

You must provide UTOOL with complete, up to date and accurate information as requested and it's your responsibility to inform UTOOL of any changes to that information.

D.Access

We will provide you with the means to ensure that your personal information held by us is correct, complete and current. You have the right to seek access to the personal information held about you and to advise UTOOL of any inaccuracy.

This information may be reviewed and updated at any time on UTOOL.com.au. You can:

  • View and edit personal information you have already given us
  • Tell us whether you want us to send you marketing information, or whether you want third parties to be able to send you any offers
  • Sign up for electronic newsletters or other alerts

There are some exceptions to this right, which are set out in the Privacy Act. If you make a request, to access your information, UTOOL.com.au will ask you to verify your identity and specify what information you require. You acknowledge that UTOOL may charge a fee to cover any administration costs involved in meeting your request.

E.Security

UTOOL has taken measures to protect the security of your personal information and to ensure that your choices for its intended use are honoured. We take precautions to protect your data from loss, misuse, unauthorized access or disclosure, alteration or destruction by various means including firewalls, password access, secure servers and encryption of credit card transactions.

When you place orders or access your personal account information, you're utilising secure server software known as SSL, which encrypts your personal information before it’s sent over the Internet. SSL is one of the safest encryption technologies available although UTOOL does not warrant or guarantee that all transactions will be 100% secure.

UTOOL will never:

1. Ask you to provide personal information such as your bank or credit card details, your address, driver's license or passport numbers via email.

2. Obtain your bank or credit card details without using a secure browser window with appropriate encryption.

F.Disclosure of your information

UTOOL strictly protects the security of your personal information and honours your choices for its intended use. UTOOL may use and disclose information relating to a person's personal preferences, beliefs and circumstances only for the purpose for which it was provided or any secondary purpose as allowed by law, unless you have advised us otherwise.

UTOOL will disclose your personal information, without notifying you, only if required to do so by law or in good faith and belief that such action is necessary to:

  • conform to the law or comply with legal process served on UTOOL;
  • protect and defend the rights or property of UTOOL and its affiliated websites and/or businesses; or,
  • act in urgent circumstances to protect the personal safety or financial security of users of UTOOL.com.au, its other sites or affiliates, and the general public.

We occasionally hire other companies to provide limited services on our behalf, including fulfilling orders and answering customer questions. We will only provide those companies the information they need to deliver the service.

Your personal information is never shared outside the company without your permission, except as agreed pursuant to the Conditions of Use and as described above. Inside the company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in Australia or any other country where UTOOL, its subsidiaries, affiliates or agents are located.

You also have a significant role to play in protecting your information. In most circumstances no person can see or edit your personal information without knowing your user name and password, so these should not be shared with others. You are entirely responsible for ensuring that your password is unique and for all activities which occur under your username and password. You must notify UTOOL.com.au immediately if you become aware of any unauthorised use of your online account. Each username and password must be used by a single user and is not transferable. Each user may have only one account with UTOOL.com.au

G.Enforcement

If for some reason you believe that UTOOL has not adhered to these principles, please notify us by email at privacy@utool.com.au and we will do our best to determine and correct the problem promptly. Please ensure that the words 'Privacy Policy' are in the subject line of the email.

H.User profiles

Every Registered Member has a unique personal profile. Each profile is assigned a unique password known only to you and us which helps us ensure that only you and UTOOL have access to your profile.

When you register, we create your profile and assign you a personal identification number. Each time you use UTOOL.com.au, we send this personal identification number back to your internet browser in the form of a cookie, which is a very small bit of code. This code is uniquely yours, and it’s your passport to seamless browsing across the Website, allowing you to make full use of UTOOL.com.au without having to re-enter information that you have already provided.

You may configure your browser so that you are notified before a cookie is downloaded or so that your browser does not accept cookies. UTOOL.com.au may use information contained in cookies to make assumptions about the user of the computer and to provide users of that computer with focused advertising that UTOOL.com.au believes may be of interest, based on that information. You can disable your cookies through your Internet browser; however, UTOOL.com.au may not function at all or as intended if cookies are disabled.

Website Users acknowledge that Sabrina Antoniou has been appointed by UTOOL as privacy officer to oversee the management of personal information in accordance with the Conditions of Use and the Privacy Act 1988 (Cth).
